Terms of Service/Terms and Conditions
Our Quotes do NOT include the electrical power-point at the motor. Please contact an electrician in the event there is no suitable power-point. Low-voltage power options may be available by us, upon request.
Quote:
· Valid for 30 days from date of issue.
· Must be accepted in writing and deposit paid (where applicable).
· Subject to final site-inspection.
Deposit/payments:
· For new garage door/gate/major installations, a 50% deposit is required upon acceptance (unless otherwise agreed in writing). Goods may not be ordered until a deposit is received. Any delay in payment may affect lead times.
· Full payment/outstanding balance is due upon installation/completion (30 days for Commercial Accounts).
· All items remain the property of L.A. Bayside until paid in full.
· If a door is ready for installation by L.A. Bayside and cannot be installed within 14 days due to a hold-up from the client’s end, the balance of full payment will be required immediately and a minimum storage fee of $45 + GST per day will apply.
Warranty:
· A 12-month parts and labour warranty is provided for new installations and new goods installed; service or repair work on existing setups carry no warranty.
· Additional warranties may be available by the Motor or Door Manufacturer. L.A. Bayside is not responsible to organise any potential warranty work outside the 12-month period. Service or other fees apply if outside the 12-month period.
· To ensure the warranty is valid, all gates, doors and automation must be serviced by an L.A. Bayside technician, at a minimum, biannually for commercial use, and annually for residential use. Very high-use doors may require quarterly servicing to be covered under warranty, these will be communicated in writing on a case-by-case basis.
· Warranty callouts are only available during our regular business hours; outside these hours, fees will apply.
· Emergency callouts are not covered by warranty.
· No warranty is provided for goods installed in corrosive environments (salty air or areas prone to corrosion).
· No warranty is provided for goods damaged due to water, rain, flooding, insects, animals or insect/animal droppings.
Installation/repairs:
· For all installations there will be no access in or out of the property for the duration of the installation; in the event the installers are not provided clear access and need to rebook, a fee of $320 + GST will apply.
· The installation area will require a 3.5-meter clearance radius, clear of any cars or obstructions.
· Whilst we endeavour to colour match as close as possible during welding and/or other repair works, we cannot guarantee that the touch up paint or sprays will be an exact colour match. Our technicians carry most standard colours and will paint or spray the area as best as possible. For a perfect paint job, a painter should be engaged separately.
Locking/safety:
· Manual locks will not be installed to automated doors; electronic lock options may be available upon request.
· We recommend installing safety beams and/or other safety products for all doors; additional costs apply.
Boundary/permits/ground conditions:
· The quoted price is subject to suitable ground conditions. Unless specified, concreting or other ground works are NOT included in our Quotes.
· No responsibility taken for utilities underground and unforeseen ground obstructions and it is the client’s responsibility to locate all underground services and advise of their location.
· All boundaries are to be clearly marked out by the client.
· All permits required and Council regulations are the sole responsibility of the client.
Building and Construction Industry Security of Payment Act 2002:
· Nothing in our Quotes or Terms and Conditions is intended to result in the exclusion of any relevant provisions of the Building and Construction Industry Security of Payment Act 2002 of Victoria. Any such exclusion will only occur to the extent allowed by the Act, where applicable.
Acceptance:
· By accepting a Quote, you have agreed to all the above Terms and Conditions.
Cancellation Policy (servicing/repairs):
Please note, if you need to cancel a scheduled booking, we kindly request that you provide us with at least 24 hours' notice before the appointed time. This allows us to make necessary adjustments to our technician's schedule. Failure to do so may result in a cancellation fee if we have already scheduled our technicians to attend.
